Course Descriptions

Easements are interests in real property and therefore, must be created by virtue of a written document with some exceptions which will be addressed in the next tutorial in this series. Written easements can be created in a wide variety of ways – from express grants at one end of the spectrum to statutory, court-sanctioned condemnations at the other end.  In this tutorial, we will explore what is involved in each of the methods that can result in a written easement and what are the considerations – such as the actual interest that is created – that should be noted and understood about each.

Pre-Requisite knowledge

It is highly recommended that Easements and Rights of Way Tutorials I (Defining the Interests) and II (Estates and Types of Easements) be viewed before taking this tutorial.

Learning Objectives

Upon completion of this course, the participant should expect to be able to:

  • Identify the ways in which easements can be creating in writing
  • Explain what constitutes a statutory dedication and outline the necessary elements
  • Describe the concept of the bundle of rights as it applies differently to an express grant versus a reservation
  • List the types of actions that might constitute acceptance of a dedication
  • Describe the two types of interests that could result from a dedication
